These Terms & Conditions ("Terms") govern your access to and use of the Word Map application, website, and services (collectively, the "Service") operated by Black Plate LLC ("we," "us," "our," or "Black Plate LLC"). By creating an account, using the Service, or continuing to access the Service after changes to these Terms are posted, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. The Service
Word Map is a micro-learning communication training platform that provides interactive lessons, AI-generated coaching, speech training tools, and linguistic resources (including rhyming, vocabulary, and metaphor generators). The Service uses artificial intelligence to generate spoken explanations, feedback, and creative word content. You are contracting with Black Plate LLC.
2. Account & Eligibility
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. If using the Service on behalf of an organization, you represent that you have the authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date.
3. Acceptable Use & Prohibited Conduct
You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:
- Using the Service for any unlawful purpose
- Committing fraud, spamming, or engaging in deceptive practices
- Infringing the intellectual property rights of others, including copyright, trademark, or trade dress
- Interfering with the security of the Service, including introducing malware, probing, scanning, scraping, or attempting to breach authentication or access controls
- Reverse engineering, decompiling, or disassembling any part of the Service
- Reselling, redistributing, or sublicensing access to the Service without our written consent
- Circumventing usage limits, paywalls, or technical restrictions
4. AI-Generated Content — Acceptable Use
Word Map uses generative artificial intelligence to produce spoken lessons, coaching feedback, and creative word content (such as metaphors, punchlines, rhymes, and vocabulary suggestions). The following rules apply specifically to AI-generated content:
- You may not use the Service to generate illegal content, deepfakes, hate speech, malware, or content intended to jailbreak or circumvent AI safety measures.
- You are solely responsible for the prompts you submit, how you use the outputs, and verifying the accuracy and appropriateness of any AI-generated content before relying on or publishing it.
- You represent that you have the necessary rights to any content you submit as input, and you are responsible for ensuring that your use of AI-generated outputs does not infringe the rights of any third party.
- We may remove, restrict, or refuse to generate content, and may suspend accounts that repeatedly violate these rules.
- AI-generated outputs may be inaccurate, incomplete, or unsuitable for regulated professional advice (including legal, medical, or financial advice) without independent oversight.
5. Intellectual Property
Black Plate LLC retains all ownership rights in the Service, including all software, documentation, branding, lesson content, and other intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal or professional development during your subscription term. You retain ownership of content you submit as input. You grant Black Plate LLC a limited license to host and process your content solely to provide the Service to you.
6. Takedown Policy
If you believe that content generated or hosted on the Service infringes your intellectual property rights, please contact us at legal@blackplate.co with a description of the allegedly infringing content and your rights basis. We will investigate and may remove or restrict access to infringing content. Accounts associated with repeated infringement may be terminated.
7. Service Level
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue any feature at any time without notice.
8. Payments, Billing & Subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
For payment, billing, tax, subscription renewals, cancellations, and refund mechanics, please refer to Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms. Subscriptions automatically renew at the end of each billing period unless canceled through Paddle or your account settings.
9. Suspension & Termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay subscription fees, or pose a security or fraud risk, or for repeated or serious violations of these Terms. Upon termination, your right to use the Service ends immediately. You may close your account at any time through the Service or by contacting us. Any data associated with your account may be deleted within 30 days of termination.
10. Disclaimers & Warranties
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. The Service is a training and coaching tool; it does not guarantee any specific outcome in your professional or personal communication abilities.
11. Limitation of Liability
To the fullest extent permitted by law, Black Plate LLC shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, data, or goodwill. Our aggregate liability for any claim arising from the Service shall not exceed the subscription fees you paid in the six months preceding the event giving rise to the claim. This limitation does not apply to liability for fraud, death, or personal injury caused by our negligence where such liability cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless Black Plate LLC from any claims, damages, or expenses arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party rights.
13. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which Black Plate LLC is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless we agree to alternative dispute resolution.
14. Assignment & Force Majeure
You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, labor disputes, internet outages, or government actions.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
